Agreement to Terms

By using our websites, apps, or in-store services (together, the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

You must be 13+ to use the Services. If you are under the age of majority in your state, you must use the Services only with a parent/guardian’s consent.

Accounts & information

Some features may require an account or contact details (e.g., phone number to receive a receipt). You agree that information you provide is accurate and kept up to date.

Orders, payments, and receipts

• Prices, taxes, and fees are shown at checkout and may vary by location.
• Payments are processed by our payment processors (e.g., Square/Stripe). We don’t store full card numbers.
• Receipts: You may request a digital or SMS receipt. See Section “SMS Receipts Program.”

Acceptable use

You agree not to misuse the Services (e.g., no unlawful, fraudulent, infringing, harmful, or disruptive activity). We may suspend or terminate access for violations.

SMS Receipts Program (Transactional)

• Program: Yummy Future Receipts via US A2P 10DLC long codes.
• Opt-in: You opt in by entering your mobile number and checking “Text me my receipt” during checkout. We send one SMS receipt per transaction when you check the box.
• Opt-out & support: Reply STOP to cancel; HELP for help. Message & data rates may apply.
• Message frequency: Per transaction (frequency varies based on purchases).
• No mobile information sharing for marketing: We do not sell or share mobile numbers or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. We may share opt-in data with service providers solely to deliver receipts (e.g., Twilio).
• Carrier disclosures: Delivery may be delayed or impacted by carrier or network issues; carriers are not liable for delayed or undelivered messages.

Third-party services

We use service providers (e.g., Twilio for messaging; Square/Stripe for payments; Google Cloud/Firebase for hosting/analytics) to operate the Services. Your use may also be subject to their terms. We engage these providers to process data on our behalf only to provide the Services.

Intellectual property

All content in the Services (branding, UI, text, images, code, and other materials) is owned by Yummy Future or its licensors and is protected by law. You may not copy, modify, distribute, or create derivative works except as permitted by these Terms or applicable law.

Feedback

If you provide ideas or suggestions, you grant us a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use them without restriction.

Disclaimer of warranties

We provide the Services on an “AS IS” and “AS AVAILABLE” basis, to the extent permitted by law. We make no warranties about uninterrupted or error-free operation, or that defects will be corrected. This disclaimer does not limit any non-waivable rights under applicable law.

Limitation of liability

To the fullest extent permitted by law, Yummy Future and its officers, directors, employees, and agents will not be liable for (a) indirect, incidental, special, consequential, or punitive damages; or (b) any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability for all claims relating to the Services will not exceed the greater of (i) the amounts you paid to us in the 12 months before the claim or (ii) $100. Some jurisdictions do not allow certain limitations; some of the above may not apply to you.

Indemnification

You agree to indemnify and hold Yummy Future harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.

Dispute resolution — arbitration & class-action waiver

• Informal resolution first. Contact support@yummy-future.com; we’ll try to resolve disputes informally within 60 days.
• Binding arbitration. If not resolved, you and Yummy Future agree to resolve all disputes through individual, binding arbitration under the FAA (9 U.S.C. §§ 1–16) and AAA Consumer Arbitration Rules (or another mutually agreed administrator). The arbitrator may award individual relief as permitted by law. Class arbitration is not allowed.
• Class-action waiver. You and Yummy Future waive any right to a jury trial or to participate in a class action.
• Small claims carve-out. Either party may bring an individual action in small claims court in Champaign County, Illinois.
• Arbitration location & fees. Hearings occur in Champaign County, Illinois, unless the rules or arbitrator permit remote proceedings. Fees follow the administrator’s consumer schedule; we will consider reasonable requests to reimburse fees.
• 30-day opt-out. You may opt out of arbitration by emailing support@yummy-future.com within 30 days after you first accept these Terms, stating your name, the phone or email on your account, and that you opt out of arbitration.

Governing law & venue

These Terms are governed by the laws of the State of Illinois, without regard to conflicts of law. Exclusive venue for any court proceeding permitted under these Terms is in state or federal courts located in Champaign County, Illinois, and you consent to personal jurisdiction there.

Changes to the Services or Terms

We may modify the Services and these Terms at any time. If we make material changes, we will update the “Effective” date above and, where required, provide additional notice. Your continued use after changes means you accept the updated Terms.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we stop offering the Services. Sections that by their nature should survive (e.g., IP, disclaimers, liability limits, arbitration) will survive termination.

Notices; electronic communications

By using the Services, you consent to receive disclosures and notices electronically (including via email or the Services). Keep your contact information current.

Entire agreement

These Terms, plus the Privacy Policy, are the entire agreement between you and Yummy Future regarding the Services and supersede prior agreements on this subject.
